The Banking Conduct Regime commenced in November 2009 and is contained in the source book known as BCOBS, which contains rules and guidance.

Guarantees

Guarantees, whether given by directors personally or by companies heading into uncharted waters are a common feature of commercial life and can be as relevant to multimillion pound deals as to small company startup.

 

Providing defences to banks or similar financial institutions is a common everyday occurance and is a service Andromeda has been dealing with for many years.

 

Although the law does not afford specific additional protection to a guarantor, the starting point should always be to examine the position in accordance with the principles of English Contract Law.

Specific Disputes

Andromeda is currently dealing with a number of cases where clients have been disadvantaged by banks in conjunction with Insolvency Practitioners.

 

This was due to in the main that they were not in a position to adequately defend themselves, due to emotional pressure, financial restraints or lack of understanding of the options that may have been available.

Settlements

Andromeda is always on the look out to find the route to commercial settlements at the earliest possible opportunity, with the least cost and without the necessity of legal action.

 

In order to get to that point it is essential that each case is dealt with in a similar manner and that all the circumstances and evidence have been meticulously examined in order that the client is in the best possible position to affect the best commercial result.

 

Even if settlement has been reached and agreed, it may be possible to revisit the case if the existance of "fraud can be found"

Fraud

The government commissioned a report to deal with the conduct of banks after the financial crash which has now been published and which identifies practices carried out by banks which must be highly questionable.

 

The banks have already been found guilty of money laundering, libor rate fixing, mis selling of interest rate swaps, and the long running PPI saga.

 

Andromeda is currently investigating on behalf of a number of clients complaints of misconduct involving alleged fraudulent activities by a number of banks.
